liNKCity Broadband Information

Pursuant to the Federal Communications Commission’s newly enacted Open Internet Rules found in Part 8 of Title 47 of the Code of Federal Regulations, the policies of Beresford Municipal Telephone Company (“Provider”) regarding network management practices, performance characteristics, and commercial terms are provided in entirety so that Provider’s current customers, prospective customers, third-party content providers and other interested parties can make informed choices regarding the broadband Internet access services offered by Provider, and the extent Provider’s network management practices may affect those services.

General information regarding liNKCity’s broadband Internet services, our most current pricing, our Service Level Agreements and our Appropriate Use Policy are all available online at http://linkcity.org/.

 This page provides additional information that the Federal Communications Commission has identified as useful to consumers and to the providers of Internet applications and content used by those consumers. Specifically, we describe the network practices, performance characteristics, and commercial terms applicable to our broadband Internet services.  

 1) Network Practices

a) Congestion Management

liNKCity strives to provide a high-quality Internet experience for all of our customers.  liNKCity does not currently engage in network management practices to address the effects of congestion.  For example, it does not restrict specific applications or traffic that may tend to increase congestion.  Based on network monitoring and customer input, liNKCity creates additional capacity to meet demand at peak periods. 

b) Application-Specific Behavior

liNKCity does not block or rate-control specific protocols or protocol ports, modify protocol fields in ways not prescribed by the protocol standard, or otherwise inhibit or favor certain applications or classes of applications.

c) Device Attachment

liNKCity customers may attach the devices of their choice to our broadband Internet access services, so long as the devices do not harm our network or other users. The devices must also be used in a manner consistent with our Service Level Agreement and Appropriate Use Policy.

d) Network Security

liNKCity email servers run Anti-Virus software to protect incoming emails that could be harmful to your computer. However, this is only one form of protection as liNKCity does not provide antivirus software for your computer itself. It is highly recommended that if your computer does not currently have anti-virus software installed, that you install a form of anti-virus software to protect your computer and data.  liNKCity uses industry standard tools and generally accepted best practices and policies to protect our customers from spam, phishing, and other unwanted or harmful online content and activities. 

 2) Performance Characteristics

 a) Service Description

liNKCity offers a variety of broadband internet service levels designed to meet the needs of every residence and business in North Kansas City, provided over liNKCity’s all fiber optic active Ethernet network.  Your broadband Internet access service performance can be affected by a wide range of factors including many of which are beyond the control of liNKCity.  Common factors that can affect performance are; the capabilities and functionality of your computer, the server with which you are communicating, the capacity of the network to which that server is attached, the distance and number of routers between your device and the other Internet end point you are contacting, and general congestion on the Internet. Because of all the different factors that can affect the performance of your broadband Internet access service, liNKCity does not guarantee specific levels of speed or latency for our shared services. liNKCity designs and provisions its network with the goal of achieving certain upload and download speeds.  The speeds identified below are Service Capability Speeds, which are the downstream rates at which your line transfers Internet access data between the network interface device at your home, office or apartment building to the first piece of routing equipment in our network.  liNKCity upstream and downstream speeds are symmetrical in that the service level you purchase is the same speed downstream and upstream.

3) Commercial Terms

 a) Pricing

Descriptions of the prices and fees for liNKCity’s broadband Internet access services are available on the liNKCity website at http://linkcity.org/

Pricing for dedicated access and dark fiber may be obtained by calling 816 412-7990.

b) Privacy

liNKCity is committed to preserving the privacy of its customers and protecting their personal data.

liNKCity does not actively monitor customer use of the Internet, customer email or other customer communications in the course of its regular operations. liNKCity is also strongly opposed to the use of third-party information-harvesting strategies.

liNKCity keeps information about its customers such as names, addresses, telephone numbers, email addresses and details about liNKCity services used by the customer. All such information is considered private. The only circumstance wherein liNCKity will disclose any of the above-mentioned information to a third party is in the event that we receive a legitimate, legally-mandated request for customer information, liNCKity will respond only within the narrow scope of that request.

liNKCity also enforces the City of North Kansas City Resolution 09-034, A RESOLUTION ADOPTING AN IDENTITY THEFT PREVENTION PROGRAM FOR THE CITY OF NORTH KANSAS CITY MISSOURI.

c) Redress Options

Your sole and exclusive remedy for any failure or non-performance of the Service (including any associated software or other materials supplied in connection with the Service) shall be for liNKCity to use commercially reasonable efforts to effectuate an adjustment or repair of the Service and, in the event such downtime exceeds twenty-four consecutive hours, to receive a pro-rata refund or credit of or against any charges otherwise payable for the Service for the period of Service downtime.  If you have questions or concerns about your liNKCity broadband Internet access service, please contact us at helpdesk@linkcity.org or by calling 816 412-7990.
